Terms of service

These terms govern the purchase of sessions and gift vouchers on artandwinemalaga.com, owned by NTE 11.22, S.L., tax ID (CIF) B93788248, with registered address at C/  Doctor Felipe Sánchez de la Cuesta y Alarcón 2, 29005 Málaga, Spain.

What the session includes

Each place entitles you to take part in a two-hour guided painting session and includes all the materials needed (24×30 cm canvas, paints, brushes, easel and apron) and drinks during the session. The painted canvas is yours and you take it home the same day.

Drop-in (no booking)

From 10:00 to 14:00 we offer Drop-in sessions for €20, VAT included, with no advance booking and limited to six people at a time.

Drop-in entitles you to one hour of painting with materials and one drink included, and to take your canvas home when you finish.

It is paid on site at the time of participation, in cash or by card. As this is a service provided immediately at the customer's request, no refund applies once the session has started.

If no places are available when you arrive, we will tell you at that moment, without this giving rise to any entitlement.

Price and payment

The price per place is €55.00, VAT included. Payment is made in full at the time of booking, through the website's payment gateway.

Opening hours

Drop-in from 10:00 to 14:00, Tuesday to Saturday. The bookable session runs from 18:30 to 20:30 on the days shown as available in the booking calendar. Closed on Sundays and Mondays, and on the dates indicated in the calendar itself.

Private room for groups

The private room is booked exclusively for a single group. The session lasts two hours and includes the same materials and drinks as the session booked by the place.

Available times: Tuesday, Wednesday and Thursday from 16:30 to 18:30 or from 18:30 to 20:30; Friday and Saturday from 21:30 to 23:30. Only one private group is booked per day.

The price is fixed: €700.00, VAT included, for up to 15 people, regardless of the number attending. Each additional person costs €30.00, VAT included, up to a maximum of 25 people in the room. The fixed price is paid in full at the time of booking; additional people are confirmed and paid for before the session starts.

You may change the date of the booking or cancel it up to 7 days before the session starts; if you cancel within that period, you will receive a full refund. Changes and cancellations made less than 7 days in advance, and no-shows, are not entitled to a refund.

Date changes and cancellations for the private room must be requested by phone on +34 632 185 842 and cannot be made through the website.

Access and minimum age

Everyone who enters the room during the session must have their own booked place, whether or not they take part in the activity.

The session is open from the age of 12, with minors always accompanied by an adult who has their own place. Alcohol is not served to minors.

Date changes

For bookings by the place, you may change the date up to 48 hours before the session starts, using the link in your confirmation email and subject to availability. Only one change is allowed per booking. For the private room, the terms set out in its own section apply.

Cancellations and refunds

For bookings by the place, you may cancel up to 48 hours before the session starts and receive a full refund. Cancellations made less than 48 hours in advance, and no-shows, are not entitled to a refund. For the private room, the terms set out in its own section apply.

Right of withdrawal

Under Article 103(l) of Spanish Royal Legislative Decree 1/2007, the 14-day right of withdrawal does not apply to contracts for leisure services provided on a specific date. The cancellation terms in the previous section apply instead.

Cancellation by us

If, for exceptional reasons, we have to cancel a session, you may choose between changing the date or receiving a full refund.

Gift vouchers

Gift vouchers are delivered by email as a code and can be redeemed for any available session. They are valid for one year from the date of purchase.

You may withdraw from the purchase of a gift voucher within 14 calendar days, provided it has not been redeemed, by writing to hola@artandwinemalaga.com. We will refund the amount using the same payment method.

Right of admission

We reserve the right of admission and the right to stop the participation of anyone who disrupts the session or fails to follow staff instructions, without refund. Alcohol is not served to anyone showing clear signs of intoxication.

Damage and participants' liability

Anyone who causes damage to the premises, furniture, materials or artworks on display through improper use or negligent conduct will be responsible for their repair or replacement.

Minors must remain under the supervision of the accompanying adult at all times, who will be responsible for their behaviour and for any damage they may cause.

Photographs

During sessions we may take photos of the atmosphere to share on our communication channels. If you prefer not to appear in them, let us know when you arrive and we will take it into account.

Governing law

These terms are governed by Spanish law. For the resolution of disputes, the parties submit to the courts of the consumer's place of residence.
